These Terms and Conditions (“Terms”) govern your access to and use of the Author Anchor website and its services (“Services”). By accessing or using our platform, you agree to these Terms. Please read them carefully as they define your rights, obligations, and legal remedies.

1. Eligible Users

To use Author Anchor, you must meet the following requirements:

Age Restriction: You must be at least 18 years old and legally capable of entering into binding agreements. Registration Requirements: All users must provide accurate and truthful information during registration. False information or impersonation will result in account termination. Legal Compliance: You affirm that your use of Author Anchor complies with all local, state, and federal laws. Violating these laws or engaging in unlawful activities while using the platform will result in immediate suspension or termination. Author Anchor retains the right to modify eligibility criteria or deny access to any user at its sole discretion.

2. Eligible Uses of Author Anchor

Author Anchor accounts are intended solely for individual use by one author unless permission is given for an account to be shared. Misuse of accounts, including unauthorized sharing, is strictly prohibited and may lead to immediate termination of your account without a refund. Author Anchor reserves the right to monitor account usage to ensure compliance.

3. Password and Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. Sharing your login details with others is prohibited. Author Anchor is not liable for any unauthorized access or activity resulting from compromised passwords. If you suspect your account has been accessed without authorization, you must notify Author Anchor immediately. Any disputes over account ownership will not be mediated by Author Anchor.

4. Conduct and User Responsibilities

Users agree to act lawfully and ethically while using Author Anchor. Prohibited activities include:

Sharing offensive, obscene, or copyrighted material without authorization. Engaging in fraudulent, defamatory, or harmful behavior. Misusing the platform to disrupt other users or contractors. Violations may result in account suspension, termination, or legal action.

5. Membership Fees and Payments

Billing: Membership fees are due upon subscription and renew automatically based on the selected billing cycle (monthly or yearly). Payments are required to maintain uninterrupted access to Services. Payment Method: Users authorize Author Anchor to charge the credit card or payment method provided during registration. You agree to maintain a valid payment method on file.Late Payments: If your payment is declined, your account may be suspended until payment is received. Author Anchor may charge penalties or late fees for overdue balances.

6. Refund Policy

Author Anchor offers a 30-day money-back guarantee. If you are dissatisfied within this period, you may request a refund. No refunds will be issued for unused portions of paid terms resulting from user-initiated cancellations.

7. Free and Promotional Plans

Author Anchor may provide free plans or promotional codes at its discretion. Free plans may include limited features and are subject to availability. Author Anchor can discontinue free plans or promotional offers at any time with a 30-day notice. Users on free plans may upgrade to paid memberships to access full features.

8. Changes to Terms

Author Anchor may amend these Terms at any time. Material changes will be communicated via email and platform notifications. Users have 10 days to review changes and may close their account if they do not agree to the updates. Continued use of the platform beyond this period constitutes acceptance of the revised Terms.

9. Contractor Engagements

Author Anchor connects users with vetted contractors, such as virtual assistants and designers. However, all engagements between users and contractors are managed independently, including:

Negotiation of terms, timelines, and payments. Monitoring and evaluation of project outcomes.

Author Anchor is not responsible for disputes, non-performance, or other issues related to contractor engagements. Engaging contractors outside the platform is prohibited and may result in account termination.

10. Privacy and Confidentiality

Users agree to safeguard the confidentiality of all personal and project information shared on the platform. Author Anchor will adhere to its Privacy Policy when collecting, storing, and processing user data. Misuse of user data by other parties is outside Author Anchor’s control and liability.

11. Security Notifications

If Author Anchor identifies a security breach, impacted users will be notified promptly. Notifications will include a description of the breach, potential risks, and measures to mitigate harm. Security alerts will be issued via email and platform notifications.

12. Liability Limitations

In the event of a default by Author Anchor, the parties agree that the user’s damages shall be limited to the fees paid to Author Anchor pursuant to this Agreement. Users will not be entitled to any further, incidental, or consequential damages, regardless of the nature of the claim or the circumstances. Author Anchor will not be held liable for anything more than the fees paid to use its services, no matter the circumstance, including any negligence on the part of Author Anchor. While Author Anchor strives to provide reliable and high-quality services, users assume full responsibility for their interactions and decisions on the platform, including engagements with contractors or reliance on the platform’s features. This limitation of liability also extends to and protects Author Anchor’s employees, owners, affiliates, and independent contractors. By agreeing to these terms, users acknowledge and accept these limitations as part of their use of the platform.

13. Attorneys’ Fees and Costs

If a user defaults under these Terms, Author Anchor is entitled to recover reasonable costs associated with enforcing this Agreement, including attorneys’ fees, expert witness fees, deposition costs, and travel expenses. These costs apply in addition to any remedies provided elsewhere in the Agreement. Users agree to reimburse Author Anchor for all such expenses if legal action is required to enforce compliance or resolve disputes arising from a user’s breach.

14. Indemnification

Users agree to indemnify and hold harmless Author Anchor, its officers, directors, employees, agents, and affiliates from any claims, damages, liabilities, or expenses arising from their actions. This includes negligence, wrongful acts, or violations of applicable laws. Users will defend Author Anchor against such claims at their own expense and cover any legal costs incurred. This indemnification extends to claims brought against Author Anchor by contractors, third parties, or other users as a result of the user’s actions.

15. No Warranty or Guarantee

Author Anchor makes no guarantees or warranties, express or implied, regarding the outcomes or performance of its services. The platform and its features are provided “as is” and “as available.” Users acknowledge that Author Anchor does not guarantee increased revenue, project success, or contractor performance. All risks associated with using the platform are assumed by the user.

16. Force Majeure

If any event occurs that materially hampers Author Anchor’s ability to perform its obligations under this Agreement, and the event is beyond its reasonable control, Author Anchor’s performance will be suspended for the duration of the event. Such events include, but are not limited to, Acts of God (e.g., fire, flood, earthquake), acts of terrorism or war, labor strikes, work stoppages, boycotts, government actions, or technical failures. If a Force Majeure event occurs, Author Anchor will notify affected users and take reasonable steps to resume operations as soon as possible. Users will not hold Author Anchor liable for delays or interruptions caused by these events. Any advance payments for affected services may be refunded or credited at Author Anchor’s discretion.

17. Governing Law and Venue

This Agreement is governed by the laws of the State of Illinois. All disputes will be resolved exclusively in McLean County, Illinois. Users agree to submit to this jurisdiction and venue.

18. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in full effect.

19. Amendments

Author Anchor reserves the right to update these Terms. Changes apply universally and will not accommodate individual user requests. Notifications will be issued for significant amendments.

20. Entire Agreement

These Terms constitute the complete agreement between you and Author Anchor, superseding all prior agreements. Any modifications must be made in writing and communicated by Author Anchor.
